Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Sole Scan mobile application (the "Service") operated by Cormac Mulvenna.

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.

1. Description of Service

Sole Scan provides users with tools to scan sneaker barcodes using their device camera, retrieve product information (including SKU and images) from third-party databases (like BarcodeLookup), fetch real-time or near real-time sneaker market data (such as lowest asks, highest bids, payouts, recent sales) from various resale platforms (including but not limited to StockX, Laced, and Alias, subject to availability and regional settings), and calculate estimated potential profit based on user-inputted retail prices and selected platform data. The Service may offer both free features and premium features accessible via subscription or purchase.

2. Accounts and Third-Party Connections

Certain features, such as fetching data directly from StockX, may require you to connect your existing account from that third-party platform using their secure authentication (OAuth) process. You are responsible for maintaining the security of your third-party accounts and for any activity that occurs through such connections initiated within our Service. Sole Scan stores authentication tokens securely using the device Keychain and does not store your passwords for third-party services.

3. Use Restrictions

You agree not to use the Service:

  • In any way that violates any applicable local, national, or international law or regulation.
  • To engage in any activity that interferes with or disrupts the Service (or the servers and networks which are connected to the Service).
  • To attempt to gain unauthorized access to the Service, user accounts, computer systems, or networks connected to the Service, through hacking, password mining, or any other means.
  • To reproduce, duplicate, copy, sell, trade, or resell the Service or its data for any purpose, unless specifically permitted in a separate agreement.
  • To use any automated system, including without limitation "robots," "spiders," or "offline readers," to access the Service in a manner that sends more request messages to the servers than a human can reasonably produce in the same period by using a conventional mobile browser.
  • To reverse engineer, decompile, or disassemble any portion of the Service or its underlying technology.

4. Premium Services & Subscriptions

We may offer premium features ("Premium Services") through a subscription or a one-time purchase, processed via the Apple App Store. Features may include, but are not limited to, unlimited scan history storage and access to data from all supported platforms.

  • Billing: Subscriptions are billed in advance on a recurring basis (e.g., monthly, yearly) as selected at the time of purchase. Payments are managed by the Apple App Store.
  • Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period through your App Store account settings.
  • Cancellations & Refunds: Subscription cancellations and refund requests are handled according to the terms and conditions of the Apple App Store.
  • Feature Changes: We reserve the right to modify or discontinue specific premium features with reasonable notice where possible.

5. Intellectual Property

The Service and its original content (excluding data sourced from third parties), features, and functionality are and will remain the exclusive property of Sole Scan and its licensors. The Service is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Sole Scan.

6. Disclaimers and Limitation of Liability

Disclaimers:

  • The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, express or implied.
  • Market data (prices, bids, asks, sales history, payouts) is obtained from third-party platforms (StockX, Laced, Alias, etc.). Product information is obtained from services like BarcodeLookup. Currency conversion rates are provided by third-party services. While we strive to present this information, we do not guarantee the accuracy, completeness, reliability, availability, or timeliness of any data provided by these third-party sources. Market conditions change rapidly, data feeds may be delayed or contain errors, and platform fees may change without notice. You acknowledge that you use this third-party data at your own risk.
  • Profit calculations provided by the Service are estimates only based on available third-party market data, platform fee structures (as understood by us), and the retail price you provide. They do not account for all potential costs (e.g., shipping, import duties, payment processing variations, item condition) and are not a guarantee of actual profit or financial outcome. You should not make financial decisions solely based on these estimations.
  • We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of Liability:

  • To the maximum extent permitted by applicable law (specifically the laws of the United Kingdom), you agree that Cormac Mulvenna, operating as Sole Scan, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
    1. your access to or use of or inability to access or use the Service;
    2. any conduct or content of any third party on or related to the Service (including inaccurate data from market platforms or barcode services);
    3. any content or data obtained from the Service, including any reliance placed by you on the completeness, accuracy, or existence of any data (including market data and profit estimations);
    4. unauthorized access, use, or alteration of your transmissions or content; or
    5. any other matter relating to the Service.
  • In no event shall the aggregate liability of Cormac Mulvenna for all claims relating to the Service exceed the greater of (a) the total amount paid by you to us for the Service in the six months prior to the claim arising, or (b) fifty pounds Sterling (£50.00).
  • This limitation of liability section does not attempt to exclude or limit liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable UK law.

7. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You can terminate your agreement by ceasing to use the Service and deleting the application from your device.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of United Kingdom, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 14 days' notice prior to any new terms taking effect, possibly via an in-app notification or update description. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
